5. Content and intellectual property
5.1 Long Haul materials
The App, software, interface, branding, icons, graphics, documentation, original map styling, and other materials we provide are owned by us or our licensors and are protected by intellectual property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.
5.2 Your content
You retain ownership of content you create or upload, such as routes, ride tracks, photos, profile information, comments, and ride cards. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, adapt for technical formatting, and display that content only as needed to operate, secure, and improve the service and to share it with the audience you choose.
You represent that you have the necessary rights to upload your content and that it does not violate law or another person's rights. You may remove supported content through the App, subject to reasonable processing and backup retention periods.
5.3 Third-party materials
Maps, points of interest, weather, imagery, routes, and other third-party content remain the property of their providers and may be subject to additional terms. You may not extract or reuse those materials outside the purposes allowed by the service and the relevant provider.
6. Cycling safety and important disclaimers
6.1 Routes, maps, and navigation
- A suggested or shared route may contain closures, private property, unsafe surfaces, restricted roads, construction, hazards, or outdated information.
- Always evaluate actual conditions and choose a route appropriate for your experience, equipment, weather, traffic, and health.
- Follow real-world signs and lawful instructions if they differ from information in the App.
6.2 Sensor and ride data
Speed, distance, elevation, grade, location, heart rate, calories, cadence, power, and related metrics are estimates based on device and third-party sensor data. GPS reception, hardware, calibration, battery state, weather, and other factors can cause errors or missing data. Do not use Long Haul data for medical diagnosis, insurance claims, legal proof, safety-critical decisions, or certified competition results.
6.3 Health
Long Haul does not provide medical advice or an exercise prescription. Consult a qualified professional before cycling if you have health concerns. Stop riding and seek appropriate assistance if you experience pain, dizziness, breathing difficulty, or other concerning symptoms.
6.4 Live group features
Location sharing may be delayed, inaccurate, or unavailable due to connectivity, permissions, device state, or service conditions. Do not rely on the App as an emergency locator or rescue service. For an emergency, contact local emergency services through an appropriate channel.
7. Service changes, interruptions, and termination
- We may add, change, limit, suspend, or discontinue features to maintain security, comply with law, improve the App, or respond to provider and business changes.
- The service may be interrupted by maintenance, network or provider failures, security incidents, natural events, government action, or circumstances outside our reasonable control.
- We may terminate or suspend access for a material or repeated breach of these Terms, a security threat, legal requirement, or discontinued service.
Where practical, we will provide reasonable notice of material service changes or termination.
8. Fees and App Store purchases
The current version may be offered without a usage fee. If paid features or subscriptions are introduced, pricing and material terms will be shown before purchase. Transactions made through the Apple App Store are also governed by Apple's payment, cancellation, and refund policies.
9. Privacy
Our Privacy Policy explains how we collect, use, disclose, store, and protect information. By using Long Haul, you acknowledge those practices.
10. Third-party services
Long Haul integrates services provided by Apple, Amazon Web Services, AMap, Caiyun Weather, Alibaba Cloud, Sentry, and potentially other providers described in the Privacy Policy. We do not control their services, availability, data accuracy, hardware, or independent terms. Your use of a third-party service may create a direct relationship between you and that provider.
11. Warranty disclaimer and limitation of liability
To the maximum extent permitted by applicable law, Long Haul is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost data, personal injury arising from unsafe cycling decisions, or loss of goodwill resulting from your use of or inability to use the service.
Where liability cannot be excluded, our total aggregate liability arising from the service will not exceed the greater of the amount you paid us for the service during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded.
12. Changes to these Terms
We may update these Terms as the service or legal requirements change. For material changes, we will provide notice in the App or through another appropriate channel. Continuing to use the service after updated Terms become effective means you accept them. If you do not agree, stop using the service and delete your account.
13. Governing law and disputes
These Terms are governed by the laws of mainland China, without regard to conflict-of-law rules, except where the mandatory consumer laws of your place of residence require otherwise. Before filing a formal claim, you and Long Haul agree to attempt to resolve the dispute through good-faith communication. If a dispute cannot be resolved, it may be submitted to a court with jurisdiction at our place of registration, unless applicable law gives you the right to bring it elsewhere.
If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver.
